The UIGEA legislation, or Unlawful Internet Gambling Enforcement Act, which was passed by President George W. Bush, focuses on preventing access to online casino gaming sites for American online casino players by making financial transactions between American financial institutions and the online casinos sites in question illegal. However, it has had the unintended result of strengthening Antigua’s position in its dispute with America before the World Trade Organization (WTO) over the supply of cross border online gambling services.

The lawmakers, in their haste to vacate, added fuel to an ongoing trade dispute between Antigua and the United States. While the conflict centers on online casino gaming, it could disrupt the businesses of hi-tech companies like Microsoft and Google if the US is unable to push off Antigua from its position. According to Mark Mendel, Antigua’s lead attorney, ‘The new legislation strengthens our arguments that the US permits domestic remote gambling but not foreign remote gambling, as it has a number of ‘carve outs’ for domestic operations that cannot apply to foreign ones.

It is just further evidence of the discriminatory effect of US laws and the [American] government’s enforcement of them.’ The future of online casino gaming lies with the enforcement of this law. Online casino fans will anxiously wait for the new Congress to take power in the hopes that the Democratic Party will help overturn this online casino ban. In the meantime, they will either abstain from gambling online, or they will do so at their own risk.
